The notarial instrument from 1263. Legal manuscript on vellum.
Instrumentum publicum – the document was drawn up by a notary publicly appointed by the Emperor or Pope, which serves as a court of proof of a legal transaction concluded by the parties in the presence of the notary. The authenticity is guaranteed by the signature of the notary and his „Manus Publica”.
This form of attestation originated in Italy in the 12th century in connection with the reception of Roman law at the University of Bologna, with the manuscripts of Ars dictandi and Ars notariae, manuals were available. Additional regulations could be laid down by statutes of municipalities and notaries.
In the Provence, this form of authentication had already been established towards the end of the twelfth century, the notarial instrument north of the Alps spread only in the 14th century!
